Let’s break it down:
EB-2 NIW Eligibility
To qualify under the EB-2 NIW (National Interest Waiver) category, you must meet one of the following requirements:
Option 1: Advanced Degree
-
A U.S. Master’s degree or higher
-
A U.S. Bachelor’s degree (or foreign equivalent) + 5 years of progressive work experience in your field.
USCIS treats this combination as the equivalent of a Master’s degree.
Option 2: Exceptional Ability
-
Demonstrated exceptional ability in the arts, sciences, or business.
-
You must meet at least 3 of the 6 USCIS criteria (such as academic records, work experience, professional memberships, recognition, etc.).
What’s the Difference?
-
Advanced Degree = Education-Based Path
-
Exceptional Ability = Skills-Based Path
Either path can open the door to a U.S. Green Card through EB-2 NIW.
