Adding Dependents from within the US

If you have already turned in your Form I-140, the petition for alien workers, and it has been approved, you can add your dependents by filling out Form I-485, the adjustment of status form, for each applicant on the petition.

You can also include two free forms based on the fact that you are adjusting your status: Form I-765 for employment authorization and Form I-131 for advanced parole (for persons who want to travel outside the US while the application is pending).

Everyone on your EB-2 NIW Application who is eligible to work can apply for employment authorization and advanced parole. They also need to do a medical check using Form I-693, a check for vaccination records, and other related medical information.

Adding Dependents from outside the US

If you are applying from outside the US, once your Form I-140 has been approved and you have received a receipt notice telling you that your I-140 has been approved, USCIS will inform the National Visa Center in your country to let them know you have an approved immigrant petition.

You will receive a letter from the National Visa Center telling you what is required from you. This will include details about the medical check. If you are going to add any dependents to your EB-2 NIW Application, they will need to fill out the visa application form DS 260, do a medical check, and go to the interview with you at the US consulate in your country.
