About the EB-2 NIW category (Advance Parole)
In this article, I’ll be discussing my experience applying for a green card under the EB-2 NIW (Employment-Based Second Preference National Interest Waiver) category.
Traveling During Application Process
Many people have questions about traveling while their green card application is pending. It is possible to travel but with the necessary permission. Without valid travel documents, such as when your F1 visa expires, you cannot leave or re-enter the US. Although it’s legal to be in the country with an expired visa on OPT (Optional Practical Training) status, leaving without the proper documentation during the application process can lead to termination of the whole procedure.
Using Form I-131 for Travel
To avoid any complications, one must apply for a travel document using form I-131. This allows the processing of your case even when you’re outside the US. You don’t have to pay any additional fees if you submit the I-131 form with your I-485 (Adjustment of Status). It’s crucial to think ahead, take advantage of such benefits, and ensure you aren’t restricted to the US while your application is being processed.
Additional Applications
Along with my I-485 application, I submitted an application for employment authorization using the I-765 form. This is also free if filed with the I-485. Such foresight allowed me to work while waiting for my green card application to be processed. Furthermore, the I-693 form provides evidence of medical checks and vaccination records.
Receiving the Combo Card
After a waiting period, we received a combo card, serving as an Employment Authorization Document. This card also functions as an Advance Parole, permitting re-entry to the US after traveling abroad.
Travel Experience to Japan
We traveled to Japan using this combo card. While airline officials were initially unfamiliar with the card, immigration on return was smooth. This experience emphasizes the importance of acquiring the Advance Parole travel document.
