Are you ready to embark on your Green Card journey through EB-1A or EB2-NIW from outside the U.S.? Here’s an overview of the Consular Processing steps to guide you through the process.
Step-by-Step Consular Processing
- Determine Eligibility
Assess whether you meet the requirements for EB-1A or EB2-NIW categories. Be sure to review the qualifications for extraordinary ability (EB-1A) or national interest waivers (EB2-NIW). - File Form I-140
Submit Form I-140, Petition for Alien Worker, along with supporting evidence such as degrees, publications, awards, and recommendation letters. - USCIS Receipt Notice
Once you file, USCIS will send you a notice confirming they’ve received your Form I-140. - Request for Evidence (RFE)
If USCIS requests additional evidence to support your application, ensure you respond thoroughly and promptly. - I-140 Decision
Wait for USCIS to adjudicate your Form I-140. Once approved, your case will proceed to the National Visa Center (NVC). - National Visa Center (NVC) Processing
The NVC will contact you to begin the next steps, which include paying the required fees and submitting the immigrant visa application (Form DS-260). - Submit Civil Documents
Prepare and upload civil documents, such as your birth certificate, passport, and marriage certificate (if applicable). - Consular Interview Scheduled
Once your documents are processed, the NVC will schedule your consular interview at the U.S. embassy or consulate in your country. - Attend the Consular Interview
During the interview, be prepared to answer questions about your application and provide original documentation for verification. - Visa Approval and Entry to the U.S.
If your visa is approved, you’ll receive your immigrant visa. Use it to enter the U.S., where you’ll officially become a lawful permanent resident. - Receive Your Green Card
After entering the U.S., your green card will be mailed to your U.S. address. Congratulations on completing the process!
Important: For EB2-NIW applications, Form ETA 9089 (Labor Certification) is not required, whereas EB-1A applicants bypass this step entirely.
